Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the use of website design and related services ("Services") provided by SMB Web Design ("we", "us", "our"), based in Edgware, Greater London, United Kingdom. By purchasing or using our Services, you ("client", "you") agree to be bound by these Terms.

2. Services Provided

We provide website design, hosting, and ongoing maintenance services for small and medium-sized businesses, delivered under a monthly subscription model.

3. Pricing and Payment

3.1 Our standard package is charged at £35 per month.
3.2 No deposit or upfront payment is required to begin.
3.3 Payment is collected monthly in advance via [payment provider, e.g. Stripe/GoCardless].
3.4 We reserve the right to change our pricing with at least 30 days' written notice. Continued use of the Services after a price change takes effect constitutes acceptance of the new price.

4. Cancellation

4.1 You may cancel your subscription at any time, including within the first month, with no minimum commitment period and no cancellation fee.
4.2 To cancel, contact us via [email/WhatsApp/contact method].
4.3 Cancellation will take effect at the end of the current paid billing period. No partial refunds are given for the remainder of a billing period already paid.

5. Website Ownership and Hosting

5.1 The website is designed, built, and hosted by SMB Web Design and remains under our management for the duration of an active subscription.
5.2 Upon cancellation, hosting and access to the live website will be suspended or removed within [X days] of the cancellation taking effect.
5.3 We do not automatically transfer website files, source code, or hosting access to the client upon cancellation. If you wish to retain or migrate the website following cancellation, please contact us to discuss handover terms, which may be subject to an additional fee.
5.4 Domain names, if registered on the client's behalf, remain the property of the client, subject to the domain registrar's own terms.

6. Included Support and Maintenance

6.1 Ongoing maintenance, minor updates, and standard support are included in the monthly fee for the duration of an active subscription.
6.2 "Maintenance" includes [define clearly — e.g. security updates, uptime monitoring, minor text/image changes] but does not include [e.g. full redesigns, new functionality builds, third-party integrations], which may be quoted separately.

7. Client Responsibilities

7.1 The client is responsible for providing accurate content, images, and information required to build and maintain the website.
7.2 The client warrants that all content, images, logos, and materials supplied to us do not infringe any third-party intellectual property rights.

8. Intellectual Property

8.1 Until the website is fully paid for and any applicable handover terms are met, design elements, code, and assets created by SMB Web Design remain our intellectual property.
8.2 Client-supplied content (text, logos, images) remains the property of the client.

9. Limitation of Liability

9.1 We will use reasonable skill and care in providing the Services but do not guarantee uninterrupted or error-free operation of the website.
9.2 To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, including loss of business, revenue, or data, arising from use of the Services.
9.3 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or for fraud.

10. Service Availability

We aim to keep websites operational at all times but do not guarantee 100% uptime, as this may depend on third-party hosting providers.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our Services after changes are published constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
